Jevon Kearse Arrested for DUI
Wow... not exactly the start I was hoping for the freak! It is Kearse's first offense, regardless not something I would think someone that wanted to restart their career would want attached to them. I doubt Fish will do anything probably just a slap on the wrist but we'll have to wait and see.... I wanna hear what you guys think of this....
Go Titans BABY!!

[UPDATE] Kearse was pulled over after 4 a.m. by Vanderbilt University police. The arresting officer said he had red, watery eyes, slurred speech and his breath smelled of alcohol. He refused a breathalyzer test.

Fisher has to start cracking the whip... and pronto.
I’m not saying make an example out of Kearse, don’t confuse it with that, but Fisher has got to find some message that whips these guys back into line and puts the fear of whatever it takes in them… It’s embarrassing off the field and could start resulting in punishments that hurt their performance on the field.

surprised
we haven’t had more silliness this offseason. Accidental gun at airport and a DUI is pretty light fare for an average NFL team this time of year. C’mon lads, you can do better than that! What a huge letdown from the Pac era.
Seriously, this kinda DUI never ceases to amaze me. Not only is he drunk and driving in the wee hours, but he has a couple of friends in the car that thought this was an OK idea.
Hmm, maybe a group of ambitious strippers could start an alternative sober ride home business. Apparently athletes don’t like to call safe rides home, but ah – what if the safe ride home was a stripper! It’s brill I tell you, brill!

I don’t see how Goodell can do anything other give him a 4 game suspension
by JasonB on Jun 23, 2008 11:10 AM CDT 0 recs
Didn't read your own cited source did you?
“Though no official reason for the suspension was announced, it was likely for a violation of the NFL’s substance abuse policy. According to that policy, the NFL commissioner can fine or suspend a player for violation of an alcohol or drug-related law. A first offense, however, is generally a fine.”
Unless he has confidential failures, Kearse shouldn’t get 4 games.

Well, if it's a first offense, then he's looking at community service...
... a trip to the substance abuse program. And who knows, that might help him. If he’s got something hidden in his recrod, well, that would b e worse. But I kind’a doubt he’d have gotten $6M out of the Titans were that the case.

is the law in tenn mandatory 2 days in jail?
I thought I saw a public service announcement on TV (heck, might have even had Jeff Fisher in it) that said that a DUI in tennessee now includes a mandatory 2 days in jail….
by zackmann on Jun 23, 2008 9:15 PM CDT 0 recs
I believe so...
for a first offense, anyway, the minimum punishment is 2 days in jail and license suspension for a year.

but refusing the Breathalyzer, especially if he refused the blood test,

Yawn...
Unbelievable how insane everyone gets because the guy drove drunk through the empty sleepy streets of Nashville at 4:30 in the morning…
The only other person on the streets of Nashville at that time was probably the cop who wouldn’t cut the athlete some slack. I hope somebody slaps that cop upside the head for messing with the harmony of our offseason. Some people do deserve special treatment – and somebody forgot to tell that bitter, underpaid, university campus rent-a-cop that he should stick to preventing freshman girls from getting raped in the bushes and leave our Titans alone.
Unbelievable that he needs to go to jail for 2 days. What a clusterf*ck of a situation.

that you think being a football player excludes you from the same laws we all have to live by…..
last week in memphis (at around 4:30 in the morning) someone was driving drunk, got going the wrong way on I-55 and ran head on to someone….of course the drunk dude walked away virtually unscathed, while the innocent, law abiding citizen died…

ok
Sounds like a horrible accident. Must have been a real imbecile to be driving the wrong direction on a highway. The loss of life is nothing but a tragedy.
It’s not because someone blows over 0.08 that they drive like idiots. An idiot is an idiot independantly of that fact. Our paternalistic laws target the lowest common denominator, and i stand by my assertion that Jevon would probably not have caused an issue at 4:30 in Nashville. I don’t think putting him in jail for a couple of days will achieve anything. Furthermore, the fat that he is not entitled to privacy over this issue is disgusting.
Don’t misinterpret the legal system as an authority on morality or risk. We are better served by being more evolved than that.

So if he would have been driving drunk at 9 p.m. that would be different? What time does it become ok to hit the streets drunk?

Yes
At 9pm, it is more dangerous to drive drunk then at 4:30am. At what time does it become ok to hit the streets drunk? I don’t know; I’m not one of these people who sees the world in absolute terms. It depends. It’s probably never safe to drive drunk. But it is safer to drive drunk when there are fewer moving targets, and that’s a fact. Then again, it’s actually not all that safe to drive a big steel machine at 60 miles per hour. I’m surprised the government doesn’t force everyone to ride bicycles and subway trains… that would be a novel way to control our own ability to hurt ourselves, wouldn’t it?
I think our Titans deserve special treatment from Vanderbilt campus security…perhaps a warning… maybe forcing Kearse to get in a cab and leaving his car on the side of the road. That would have been appropriate. Instead, the cop felt the need to humiliate a local sports hero by bookng him which inevitably would lead to his mugshot being pasted all over ESPN, Fox Sports, the NFL Network, etc…
The punishment doesn’t fit the crime, that’s the bottom line.

puh lease
Even at 4:30 a.m. there are lots of immovable objects around that you can kill yourself and/or your passengers with if you are driving around sauced up. It’s never OK, it’s against the law, and it doesn’t matter who you are or who the police force is stopping you. The VU cops did exactly what they were supposed to, and Jevon was doing something he absolutely shouldn’t have. Do the crime, do the time.

It's good to have mindless sheep as citizens, isn't it?
Never question authority – Assume the law is correct, and if the government tells you that something is wrong, or more precisely how wrong something is, you should agree with them fully…
That’s fine – you can think that way, that’s your business. I prefer to think for myself.

No
I never said driving drunk is ok. Why does eveyone here insist on erroneously paraphrasing my points of view as one-dimensional, simplistic and basically idiotic statements.
I said that driving drunk at 4:30 in the morning when the only person Kearse was likely to hurt was himself, does not warrant public humiliation and jail time.
Of course everyone is entitled to their opinion, but I don’t just accept blindly that the legal system and the government “got it right”.

Cute comment
But I challenge you to find one link on the internet that says Leonard Little’s accident happened at 4 in the morning.
In any case, I am a big believer that people who actually cause accidents while driving drunk should be seriously punished. As far as I know Kearse didn’t cause an accident.

I don't like to call things dumb,
but that is dumb. You cannot say that people shouldn’t be punished unless they cause an accident. Should attempted murder no longer be a charge in our court system. They didn’t actually murder the person you know.

When did I say that...
People should not be punished unless they cause an accident?
The Leonard Little comparison is too harsh. Little actually killed someone.
To recap:
In the Kearse case I don’t think the punishment fits the crime for the following reasons:
1. As a celebrity, he not only gets the typical criminal punishment but along with it he gets publicly humiliated… in other words the punishment is harsher for him than it would be for you or I.
2. He was driving around at 4:30 in the morning, when basically nobody is on the roads. As a result the only person he would have likely hurt would have been himself, had he gotten into an accident. To me, this is less wrong than driving drunk in the afternoon. It doesn’t matter how much less wrong it is, but since the whole point of drunk driving laws is to reduce the level of risk on the roads, if the level of risk is lower because the roads are empty, the punishment should be less severe. Could this be implemented as policy? I’ll admit, not really, but at the end of the day the cops have the ability to exercise judgment.
3. Kearse deserves special treatment because he is a) a Titan, b) a well -liked celebrity who is probably more effective at doing community service without a shattered reputation, and the cop (who, I am assuming knew who Kearse was) should have immediately known that in this case, it probably did not serve the greater good to charge the driver.
The cop should have put Kearse in a cab and given him a stern warning.
As far as your attempted murder argument, that’s pretty weak. Crime requires mens rea, or rather the “intent” to commit a crime.
People don’t intend to get into accidents if they happen to drive drunk. The crime of drunk driving is a misnomer. People don’t intend to drive drunk. Their intent is usually to go home.

But they intend
to get their by driving drunk. So their intent is to drive and doing so drunk is a crime. I usually try to stay out of this nonsense. Shame on me for getting caught up.

Do you personally feel that Jevon deserves 2 days in jail, deserves to lose his license for a year, deserves public censure, and deserves to pay a hefty fine?
Is that the appropriate punishment?

1. 2 days in city lock-up isn't hell on earth... or so i hear
2. losing your license isn’t a big deal when you’ve made the money he’s made
3. The public has already forgiven him
4. worried about a fine? see point number 2

also, the reason he refused the Breathalyzer/BAC test
is because that makes it much easier to plead down to a lesser charge, in which case he’d just get a fine and his license would be suspended for refusing to take the test.

I would argue
that the punishment actually would be harsher for me
Cause I can’t afford the thousands of dollars for a lawyer and the thousands of dollars for a fine or to hire someone to drive me around.
Jevon can do that without even noticing.
A little harassment from the trolls on the Tennessean website probably really doesn’t bother him.

oh ok
now we’re just name calling. nice. very mature.
actually i have a very deep seated distrust of authority, bordering on paranoia, but in this case i happen to believe that driving around stinking drunk is a kinda bad idea – and yes spending some time in the slammer for it isn’t beyond the pale.
so I don’t just “blindly accespt that the legal system…. got it right”. It’s just that in this case I do think they got it mostly right. And since you’re the only one posting here that seems to think otherwise, maybe it’s your viewpoint that’s mindless and not ours.
